The Town of Foxfield recently had a comprehensive culvert inspection performed. This inspection identified culverts that need maintenance or repair. Generally, maintenance will involve removing debris so that water can flow without impediment. Clean-up maintenance should not change the culvert structure or grading; therefore, no permit is required. Repairs may require excavation, culvert repair or replacement and thus a right-of-way (“Row”) permit is required.
There are insurance and bonding requirements to getting an ROW permit that are difficult for an individual to meet. If you hire a grading and excavation contractor, those requirements will be met by the contractor. If possible, you might want to share the cost of a contractor with several of your neighbors and have the work performed at the same time.
You may receive a letter similar to this communication if your property was identified in the culvert assessment. The Town will be requesting that you clean out or repair your residential culverts as noted. Understanding that projects such as this can take time, the Town is asking residents to address the cited issues by August 31, 2024. After that time the Town Code Enforcement Officer will reinspect the culverts.
What else to know:
While there is usually a cost associated with right-of-way permits, the application fees will be waived for any affected residents. Any additional engineering fees incurred by the Town may still be passed along.
The Town is also working on repairing culverts owned by the Town.
While the Town cannot endorse any vendors, companies that specialize in drainage or culvert repairs can be found online and certain landscape companies may be able to assist. Lastly, we are providing some information that may be helpful.
